3. Digital Products

Our products may include downloadable files, digital guides, programmes, plans, educational materials, videos, online resources, or other digital content.

Product descriptions and information are provided to help you understand what you are purchasing. We may update, improve, or modify our digital products where reasonably necessary, provided this does not materially reduce what you have purchased or affect rights that cannot legally be excluded.

4. Orders and Payment

By placing an order, you agree that the information you provide is accurate and that you are authorised to use your selected payment method.

Prices will be displayed before you complete your purchase. Any applicable taxes, fees, or additional charges will be shown where required.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases of suspected fraud, payment failure, obvious pricing errors, or misuse of our services. Where we cancel a paid order and you are entitled to reimbursement, the relevant payment will be refunded.

Unless expressly stated otherwise, purchasing a digital product gives you a limited, non-exclusive, non-transferable licence to use that product for your personal, non-commercial use.

Your purchase does not transfer ownership of our intellectual property to you.

You may not reproduce, resell, redistribute, sublicense, publish, share, commercially exploit, modify for resale, or make our digital products available to others without our prior written permission.

7. Intellectual Property

All intellectual property rights in our products, website content, branding, designs, text, graphics, videos, downloads, programmes, materials, and other original content belong to FlexyTech Fitness Ltd or the relevant rights holder.

Except for the limited right to use products you have legitimately purchased, no rights are granted to you unless expressly stated in writing.

Unauthorised copying, distribution, resale, publication, or commercial use of our intellectual property may result in suspension or termination of access and may lead to further action where appropriate.

8. Refunds

Our digital products are subject to our Return & Refund Policy.

Where a purchase qualifies for a refund under that policy, eligible refunds are issued as full refunds rather than partial refunds.

Our stated refund policy does not limit any statutory rights or remedies that you may have under applicable consumer law.

You are responsible for deciding whether exercises, programmes, activities, or information are appropriate for your circumstances. Where appropriate, seek advice from a suitably qualified healthcare professional before beginning a new exercise or fitness programme, particularly if you have concerns about your health or ability to exercise safely.

Stop an activity and seek appropriate professional assistance if you experience symptoms or circumstances that require medical attention.

11. Results

Individual fitness results vary. Factors such as consistency, nutrition, lifestyle, physical condition, experience, and other circumstances can affect outcomes.

We do not guarantee specific results from using our products, programmes, or information.

12. Acceptable Use

You must not use our products, website, or services unlawfully or in a way that infringes another person's rights.

You must not attempt to gain unauthorised access to our systems, interfere with the operation of our services, distribute malicious software, circumvent access restrictions, or use our products in a fraudulent or abusive manner.

Where you purchase as a consumer, these Terms do not exclude or restrict rights or remedies provided to you by applicable law.

16. Suspension and Termination

We may suspend or terminate access to our products or services where you materially breach these Terms, engage in fraud or unlawful activity, infringe our intellectual property rights, or misuse access to our products.

Where appropriate, we may give you a reasonable opportunity to remedy a breach before terminating access.

Termination does not affect rights or obligations that arose before termination.
